PRIVACY POLICY

Photo Texas Photography is entrusted with the images and other information that is linked or is reasonably linkable to an identified or identifiable individuals, including minors (collectively, Personal Information). We take that position of trust seriously.
This policy is new but describes the privacy practices we have followed prior to the formal adoption of this policy.
Collecting Information. We will only collect Personal Information when and to the extent we are authorized by that individual, if they are an adult, or by a parent or guardian if that individual is a minor. When we collect Personal Information in person, we use background checks and other reasonable steps before we permit an employee or contractor to interact with individuals on our behalf. We do not request contact information (such as phone numbers or email addresses) for minor children. We may rely on a consent provided by a school, club, or other organization if we reasonably believe that organization is authorized by the individual, or a parent or guardian, to give us that consent. If you come to our web site to order products or services from us, we will collect information so that we can fulfill your order. (Personal Information does not include aggregated or anonymized data that cannot reasonably be used to identify an individual.)
Limited to Residents of Texas. We do not knowingly collect, use, disclose, or retain Personal Information about anyone who is not a resident of the State of Texas except to process online or telephone orders from out-of-state residents for products or services. You agree, if you are not a resident of Texas, not to provide Personal Information to us except to place an order with us.
Using Information. We only use Personal Information to provide products and services to the individual (such as offering sets of photographs) or to an organization that individual belongs to (such as a school directory, yearbook, or photo ID). If the individual is a minor child, we provide products and services to parents or guardians, and not to the minor child. When we get consent to collect Personal Information, we will describe any other potential uses for that Personal Information. We may use Personal Information to improve our products, services, and business processes, but we will not use Personal Information for any different or additional uses unless we get express consent.
Sharing Information. We share Personal Information with our vendors and subcontractors so that we can provide our products and services and operate our business. We have contractual commitments [verify] with each vendor and subcontractor that prohibit them from using or sharing any Personal Information we provide for any purpose other than providing products or services for us. We use commercially reasonable efforts to ensure Personal Information is encrypted while in transit.
Selling Personal Information Only in the Context of Selling Our Business. We do not sell Personal Information. If we were to sell our business, the buyer would as part of that purchase acquire all of the Personal Information in our possession at that time, which would continue to be subject to the restrictions in this Privacy Policy.
Retention, Correction, and Deletion of Personal Information. We retain Personal Information indefinitely, unless we are asked to delete it, so that individuals can order products and services from us in the future. We currently store Personal Information on servers and storage devices located in the United States, which are either controlled by us or by our vendors. We use commercially reasonable efforts to ensure Personal Information is encrypted while in storage. Individuals may ask us to correct or to delete Personal Information about themselves (or about their minor children) by contacting us using the information under the Questions heading below, and we will promptly respond. (Personal Information in our automatic backup archives will continue to be retained after that deletion until deleted in the ordinary course of our business, but the Personal Information in those backup archives will not be accessed after we are asked to delete it.)
Compliance with Applicable Law. Our products and services are governed by applicable laws that protect the confidentiality of student information, including but not limited to Federal Educational Records and Privacy Act. To the extent applicable law conflicts with this privacy policy, we must comply with applicable law.
Legal Actions. Notwithstanding the foregoing, we may use and disclose Personal Information when and as we determine to be necessary to respond to subpoenas, warrants, or other legal process, or to respond to or to prosecute legal issues, investigations, and claims. In the unlikely event this circumstance arises, we will (if permitted by applicable law) notify the affected individuals and will use all reasonable efforts to protect the confidentiality of, and limit the disclosure of, Personal Information.
Changes to this Privacy Policy. We can amend this policy by posting the new policy at https://PhotoTexasPhotography.com/privacy-policy and updating the Effective Date at the top of this policy. Personal Information that was collected before the policy is updated will continue to be governed by the policy in effect when it was collected.

Please note that even if you request deletion of your Personal Information, you may consent to provide Personal Information to us in the future – for example, in a new school year. If you do, we will resume collecting, using, and disclosing your Personal Information in accordance with our Privacy Policy.
